Terms And Conditions

These terms and conditions ("Terms") govern your use of the EPAC platform ("Platform") and related services provided by ALMUTANI TRANSPORT AND DELIVERY ("Company"). The Platform consists of three applications available on both iOS and Android: the Customer Order Application ("Customer App"), the Store & Restaurant Application ("Store App"), and the Driver Application ("Driver App"). By accessing or using any part of the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please refrain from using the Platform.

1. Account Registration and Use

1.1. Account Creation: To use certain features of the Platform, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

1.2. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify the Company immediately of any unauthorized use of your account or any other breach of security.

2. Services

2.1. Service Overview: The Company provides an online platform for ordering medicine items ("Products") through the Customer App, managed by stores and restaurants through the Store App, and delivered by drivers using the Driver App.

2.2. Service Modifications: The Company may modify or discontinue, temporarily or permanently, any part of the Platform without notice.

2.3. Service Refusal: The Company reserves the right to refuse service, terminate accounts, or cancel orders at its discretion, including, without limitation, if the Company believes that user conduct violates applicable laws or is harmful to the interests of the Company.

3. Ordering and Payment

3.1. Order Placement: By placing an order through the Customer App, you agree to purchase the Products selected and pay the specified price, including any applicable taxes and fees.

3.2. Payment Methods: Payment processing services are provided by third-party payment processors. You agree to provide accurate payment information and authorize the Company to charge your payment method for any purchases made through the Platform. Available payment methods include credit card and cash on delivery (COD).

3.3. Order Cancellation: Clients can cancel orders through the Customer App before the medicine is prepared. Once preparation has started, cancellations may not be accepted.

3.4. Refund Policy: Users can claim a refund in certain cases, such as if medicine items are not in good condition or if the driver is significantly late. All refund claims are subject to the Company’s assessment and discretion.

4. Delivery

4.1. Delivery Efforts: The Company will make commercially reasonable efforts to deliver the Products to the address specified in your order within the estimated delivery time frame.

4.2. Delivery Information: You are responsible for providing accurate delivery information and ensuring that someone is available to receive the delivery at the specified address.

4.3. Risk of Loss: The risk of loss and title for the Products pass to you upon delivery.

5. Intellectual Property

5.1. Ownership: The Platform and its contents, including but not limited to text, graphics, logos, button icons, images, audio clips, and software, are owned by the Company or its licensors and are protected by copyright, trademark, and other intellectual property laws.

5.2. Restrictions: You may not use, reproduce, modify, distribute, or display any portion of the Platform without the prior written consent of the Company.

6. Limitation of Liability

6.1. Liability Exclusion: To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or use, arising out of or in connection with your use of the Platform.

6.2. Liability Cap: In no event shall the aggregate liability of the Company exceed the total amount paid by you for the Products purchased through the Platform.

7. Governing Law

7.1. Jurisdiction: These Terms and any disputes arising out of or in connection with these Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates and adjudicated in the courts of Abu Dhabi.

9. Changes to Terms
